Please read these terms carefully before using CreditTally.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING CREDITTALLY. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE OUR SERVICES.

1. AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and CreditTally LLC ("Company," "we," "us," or "our"), governing your access to and use of the CreditTally website located at https://www.credittally.io, our browser extensions, our iOS Safari extension, and any related software, services, or features (collectively, the "Services").

By creating an account, accessing, or using any part of the Services, you confirm that you are at least 18 years of age, have the legal capacity to enter into these Terms, and agree to be bound by them. If you are accessing the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page or by sending an email to the address associated with your account. Your continued use of the Services after any changes constitutes acceptance of the revised Terms.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Services and all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, logos, and the compilation thereof (collectively, the "Content") are owned by or licensed to CreditTally LLC and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal, non-commercial purposes. You may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, sub-license, or otherwise exploit any Content for any commercial purpose without our prior written permission.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:
  • You are at least 18 years of age;
  • All registration information you submit is truthful, accurate, current, and complete;
  • You will maintain the accuracy of such information and promptly update it as necessary;
  • You have the legal capacity and agree to comply with these Terms;
  • You will not access the Services through automated or non-human means, whether through a bot, script, or otherwise;
  • Your use of the Services does not violate any applicable law or regulation.

4. USER REGISTRATION AND ACCOUNTS

You must register for an account to access the Services. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your password and for all activity that occurs under your account. You must notify us immediately at support@credittally.io if you suspect any unauthorized use of your account.

We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. You may not create an account for anyone other than yourself without permission.

5. PLANS AND FEATURES

CreditTally offers the following plans:

Free Plan

  • Add up to 2 credit cards
  • Basic card reward recommendations
  • Web access only (no browser or mobile extension)
  • Includes advertisements

Max Plan

  • Add up to 10 credit cards
  • Full recommendation features including browser extension (Chrome/Edge) and iOS Safari extension
  • Manual reward calculator
  • Ad-free experience
  • $3.99 per month (monthly billing) or $2.99 per month billed annually ($35.88/year)

We reserve the right to modify, discontinue, or change the features included in any plan at any time with reasonable notice. Any material reduction in features for paid subscribers will be communicated by email with at least 14 days' advance notice.

6. SUBSCRIPTIONS, BILLING, AND PAYMENT

Paid subscriptions are billed through Stripe, Inc., our third-party payment processor. By subscribing to the Max Plan, you authorize us to charge your payment method on a recurring basis (monthly or annually, as selected at checkout) until you cancel.

Subscription fees are charged at the beginning of each billing period. If a payment fails, we reserve the right to suspend or terminate your access to Max Plan features until payment is resolved. All prices are listed in US dollars and are exclusive of applicable taxes, which you are solely responsible for paying.

You may switch between monthly and annual billing at any time through the Account > Manage Billing portal, powered by Stripe. Changes will take effect at the start of the next billing period. We reserve the right to change subscription pricing at any time; we will provide at least 30 days' notice to active subscribers before any price increase takes effect.

7. NO REFUND POLICY

ALL SUBSCRIPTION FEES ARE NON-REFUNDABLE. This includes, without limitation, fees for the current billing period at the time of cancellation, unused portions of annual subscriptions, and charges resulting from failure to cancel prior to a renewal date. We do not provide prorated refunds for partial billing periods.

By subscribing, you acknowledge and agree that you will not receive a refund under any circumstances, including but not limited to: dissatisfaction with the Services, failure to cancel prior to a renewal, downgrading to a lower plan, or account termination due to a violation of these Terms.

Notwithstanding the foregoing, in the event of a technical error directly attributable to CreditTally that prevents you from accessing the Services for more than 72 consecutive hours, you may contact us at support@credittally.io and we will review your account on a case-by-case basis.

8. CANCELLATION

You may cancel your Max Plan subscription at any time by navigating to Account > Manage Billing and following the cancellation instructions in the Stripe billing portal. Cancellation will take effect at the end of your current paid billing period; you will retain access to Max Plan features through that date.

After cancellation, your account will be automatically downgraded to the Free Plan. Cards exceeding the Free Plan limit (more than 2) will be retained in your account but will not be active for recommendations until you re-subscribe to the Max Plan or manually remove the excess cards.

You may delete your account entirely by contacting us at support@credittally.io. Account deletion is permanent and irreversible; all stored data will be removed in accordance with our Privacy Policy.

9. PROHIBITED ACTIVITIES

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
  • Use the Services in any manner that violates any applicable federal, state, local, or international law or regulation;
  • Attempt to gain unauthorized access to any portion of the Services, or any other systems or networks connected to the Services;
  • Use any automated means (including scrapers, bots, spiders, or crawlers) to access, monitor, or copy any part of the Services;
  • Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of any portion of the Services;
  • Share, sell, resell, sublicense, or otherwise transfer your account or subscription to any third party;
  • Use the Services to transmit any unsolicited or unauthorized advertising, promotional material, or spam;
  • Interfere with or disrupt the integrity or performance of the Services or the data contained therein;
  • Circumvent or attempt to circumvent any technological measures we employ to protect the Services or enforce subscription plan limits;
  • Use the Services to conduct any fraudulent, abusive, or otherwise illegal activity.

10. USER-PROVIDED CONTENT

The Services allow you to submit credit card information (including card name and last four digits of the card number) to enable reward recommendations ("User Content"). You represent that you own or have the right to submit such information, and that doing so does not violate any agreement with your card issuer or any applicable law.

CreditTally does not store full card numbers, CVV codes, expiration dates, or any sensitive payment card data. You retain all ownership rights in your User Content. By submitting User Content, you grant CreditTally a limited, non-exclusive license to process and use that data solely to provide the Services to you.

CreditTally is not a financial institution, credit card issuer, or financial advisor. Reward rate information is provided for informational purposes only. Actual rewards earned are determined solely by your card issuer and may differ from estimates provided by the Services.

11. BROWSER AND MOBILE EXTENSIONS

CreditTally offers a browser extension available on the Chrome Web Store and an iOS Safari extension distributed through the Apple App Store. Use of these extensions is subject to these Terms in addition to the terms and policies of the respective platform (Google LLC and Apple Inc.).

The browser and mobile extensions are available exclusively to Max Plan subscribers. We grant you a limited, non-exclusive, revocable, non-transferable license to install and use the extension on devices you own or control, solely for personal, non-commercial purposes.

The extension reads page content on supported shopping websites solely for the purpose of detecting cart contents and providing reward recommendations. The extension does not transmit full card numbers, passwords, or any payment credentials. You may disable or remove the extension at any time from your browser or device settings.

For Apple App Store users: in the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, Apple's terms will govern solely with respect to Apple's own rules and policies. Apple is not a party to these Terms and bears no responsibility for the Services.

12. THIRD-PARTY SERVICES AND PLATFORMS

The Services may contain links to, or integrate with, third-party websites, services, or platforms including but not limited to Stripe (payment processing), Apple (App Store), Google (Chrome Web Store), and various credit card issuers. These third-party services are governed by their own terms of service and privacy policies. CreditTally has no control over and assumes no responsibility for the content, privacy practices, or conduct of any third-party service.

By using Stripe as our payment processor, your payment data is subject to Stripe's Privacy Policy. CreditTally does not store or have access to your full payment card details.

13. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CREDITTALLY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

REWARD RATE DATA IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. CREDITTALLY MAKES NO WARRANTY THAT REWARD ESTIMATES ARE ACCURATE, COMPLETE, OR CURRENT. ACTUAL REWARDS ARE DETERMINED SOLELY BY YOUR CARD ISSUER. CREDITTALLY IS NOT A FINANCIAL ADVISOR, AND NOTHING IN THE SERVICES CONSTITUTES FINANCIAL, INVESTMENT, OR LEGAL ADVICE.

14. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREDITTALLY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO CREDITTALLY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless CreditTally LLC, its affiliates, officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including any intellectual property or privacy rights; or (d) any User Content you submit.

16. TERM AND TERMINATION

These Terms remain in effect while you use the Services. We reserve the right to suspend or terminate your account and access to the Services, with or without notice, for any reason, including if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if required to do so by law.

Upon termination for cause (i.e., a violation of these Terms), your access to the Services will cease immediately and no refund will be issued for any remaining subscription period. Upon termination, all provisions of these Terms that by their nature should survive will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

17. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time without prior notice. We are not obligated to update any information on the Services. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems requiring maintenance that results in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, or discontinue the Services at any time without notice. You agree that we have no liability for any loss, damage, or inconvenience caused by your inability to access or use the Services.

18. GOVERNING LAW

These Terms and your use of the Services are governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States of America, without regard to its conflict of law provisions. To the extent that any lawsuit or court proceeding is permitted under these Terms, you and CreditTally agree to submit to the personal jurisdiction of the state courts located in Richmond, Virginia, and the United States District Court for the Eastern District of Virginia.

19. DISPUTE RESOLUTION

Informal Resolution

Before initiating any formal dispute, you agree to first contact us at support@credittally.io and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days of receipt of your written notice. If the dispute is not resolved within that period, you may proceed to binding arbitration as set forth below.

Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally shall be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration will be conducted in Richmond, Virginia, unless both parties agree otherwise. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Each party shall bear its own costs of arbitration. AAA filing fees will be apportioned in accordance with the AAA Consumer Arbitration Rules. For claims under $10,000, the Company will pay all AAA filing and arbitrator fees, provided the arbitrator does not find your claim to be frivolous.

Class Action Waiver

YOU AND CREDITTALLY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Exceptions

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened misappropriation of intellectual property rights or confidential information. Additionally, claims of $500 or less may be brought in small claims court in Richmond, Virginia.

Limitation on Claims

ANY CLAIM OR CAUSE OF ACTION MUST BE FILED WITHIN ONE (1) YEAR AFTER IT ARISES. CLAIMS FILED AFTER THAT PERIOD ARE PERMANENTLY BARRED. You may only seek individual remedies limited to what you actually paid to CreditTally. You waive any right to seek damages in excess of the amounts paid by you for the Services.

20. MISCELLANEOUS

Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and CreditTally regarding the Services and supersede all prior or contemporaneous communications, whether electronic, oral, or written.

Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms or any rights or obligations herein without our prior written consent. We may assign our rights and obligations without restriction.

Notices. We may provide notices to you via email to the address associated with your account, or by posting to the Services. You may provide notices to us by emailing support@credittally.io.
